Nadex Self-Certification to Authorize Limitation of Trading Privileges


On April 7, 2017, North American Derivatives Exchange, Inc. (“Nadex”, the “Exchange”) submitted to the Commodity Futures Trading Commission (the “Commission”), pursuant to Section 5c(c)(1) of the Commodity Exchange Act, as amended (“Act”), and section §40.6(a) of the regulations promulgated by the Commission under the Act (the “Regulations”), its intent to amend language in its Rule 3.6 to give Nadex, in its capacity as an exchange, to limit trading privileges in instances where no Rule violation has occurred that could lead to disciplinary action, but where Nadex has determined the action is necessary or appropriate to minimize risk, or otherwise protect he Exchange, the market, or its Members. Absent Commission objection, this submission will become effective April 25, 2017.
