Nadex Implements Inactivity Fee and Amends Market Maker Fees
Pursuant to Section 5c(c)(1) of the Commodity Exchange Act, as amended (“Act”), and section §40.6(a) of the regulations promulgated by the Commodity Futures Trading Commission (the “Commission”) under the Act (the “Regulations”), North American Derivatives Exchange, Inc. (“Nadex”, the “Exchange”) submitted to the Commission on April 17, 2020 its plans to implement a dormant account inactivity fee of $10.00 per month. For purposes of the fee, a dormant account is an account that has not engaged in any trading activity for a period of twelve (12) consecutive months. If at any time a dormant account carries a balance less than $10.00, Nadex will reduce its fee to the amount of the remaining account balance bringing the balance to $0. Pursuant to Nadex Rule 3.3(f), Nadex may terminate a $0 balance dormant account.
Additionally, Nadex is amending the fees it charges duly appointed Market Makers as indicated in the Fee Schedule. Nadex will also be suspending the Wide Spread Surcharge Market Makers incur until further notice.
Pursuant to the 10-day filing period under Regulation 40.6(a)(3), this filing will become effective May 4, 2020. Changes to the Market Maker fee will go in effect on May 4, 2020. The dormant account inactivity fee will be implemented July 1, 2020.
